Limited Use Agreement

Purchasing/or prior purchase of my Country Graphic CD(s), or my downloadable Country Graphic Collection(s) online, or use of my graphics/artwork/printables/designs in my Fun & Free section of my web site, known as www.grandmageorge.com, indicates your acceptance to abide by the terms of this "Limited Use Agreement" (herein after referred to as "the agreement"). If you do not agree with the terms of "the agreement" DO NOT use my graphics/artwork/printables/designs for business use or resale in any manner or in any medium. Once your purchase is complete, a refund cannot and will not be given, included but not limited to the fees for "the agreement." The fee for "the agreement" is $50.00 (fifty dollars) for a period of two years.

My graphics/artwork/printables/designs contained in my Country Homespun Graphic CD(s), or my downloadable Country Homespun Graphic Collection(s) online, or use of my graphics/artwork/printables/designs in my Fun & Free section of my web site are protected by international copyright laws. My graphics/artwork/printables/designs are copyrighted and I maintain the full legal rights to my copyrighted graphics/artwork/printables/designs at all times.

Graphics/artwork/printables/design credit to "Country Homespun Graphics by Grandma George" with a reference to "www.grandmageorge.com" must be given on all products created or an insert card or label must accompany each item created giving the above copyright credit. The font size on the insert card credit must be at least font size 10. Label credit must in a readable font size for the average consumer. The manner in which labels are attached may be either affixed to the item sold or "hang tag" in fashion.

My graphics/artwork/printables/designs may be used for resale purposes/product enhancement provided the required "Limited Use Agreement" fee is paid every two years. "The agreement" allows my graphics/artwork/printables/designs to be used on handmade/finished products shipped or delivered directly to the consumer. The professional crafter may use my graphics/artwork/printables/designs to make hand-finished products for resale. Products/items created using a computer are considered hand-finished products for the purposes of this agreement. This agreement does not apply to nonprofit or noncommercial use. See my Terms of Use for additional information regarding nonprofit or noncommercial use.

The use of my graphics/artwork/printables/designs to enhance a product (e.g., a stitched pattern on an item of clothing, etc.), to be sold with a product (e.g., bag toppers/tags, etc.), or to design a product (e.g., affixed to/painted on wood, matted as a picture, candy wrappers, etc.) for any mass production is not allowed under the terms of "the agreement". Assembly line painting by the terms of "the agreement" is mass production.

"The agreement" does not guarantee rights to exclusive use/rights.

Your product(s) may not include the use of my graphics/artwork/printables/designs used in any manner that competes with my graphic business on or off line. You may not redistribute my graphics/artwork/printables/designs on any graphic site, on CD or in any other manner for purchase or free of charge. Redistribution of my graphics/artwork/printables/designs other than the manner stated in "the agreement" is strictly prohibited. Prohibited use includes, but is not limited to: use of my graphics/artwork/printables/designs to make email stationery, email signature tags, sharing or redistributing by using email, newsgroups, message boards or any type of graphic group (i.e., YahooGroups).

The use of my graphics/artwork/printables/designs on commercial websites is allowed provided my graphics/artwork/printables/designs are not downloadable or printable in any fashion. Your finished products made with my graphics/artwork/printables/designs may be displayed on your commercial web site in photograph form or in a reduced size in such a manner in which to deter the downloading or screen capture of my graphics/artwork/printables/designs thereby violating my copyrights to my original graphics/artwork/printables/designs. You may NOT use my graphics/artwork/printables/designs to make other/new images to be downloaded on or off the web or design projects/patterns to be downloaded or published on or off the web in any manner or by the use of other works in any form, media or technology now known or later developed. To use my graphics/artwork/printables/designs on your product(s) on any web site you must submit written notification of your intent to use my graphics/artwork/printables/designs, including your name, valid web site address and valid email address with said notification. You agree to keep me notified of your valid and current web site address and email address. You may NOT alter my graphics/artwork/printables/designs in any manner without
prior written permission from me.

You may NOT grant, or warrant the royalty-free, perpetual, irrevocable, non-exlusive or fully sublicense rights or license to use, reproduce, adapt, modify, translate, publish, or create derivative works from my graphics/artwork/printables/designs to any other individual/party. Nor may you grant the right to any party to distribute or incorporate my graphics/artwork/printables/designs in other works in any form, media or technology now known or later developed.

My graphics/artwork/printables/designs are to be used by small businesses...those individuals who make homemade/handmade crafts and gifts, homemade greeting cards, business cards, labels, etc. Products/items created using a computer are considered hand-finished products for the purposes of this agreement. My graphics/artwork/printables/designs cannot be used on items/patterns/projects sold when mass produced. Large business owners/retail stores may contact me regarding a written agreement of either royalties or a price per graphic that is used, and credit required on the item that is being sold with my graphics/artwork/printables/designs on it.

A fee of $50.00 (fifty dollars) is required, every two years, to use/continue using my graphics/artwork/printables/designs on items you offer for sale on or off the web. You agree to CEASE and DESIST immediately using my graphics/artwork/printables/designs on items you sell if this fee is not paid in full within 10 (ten) days of the renewal due date. I reserve the right to deny the use of my graphics/artwork/printables/designs to any individual or the renewal of my "Limited Use Agreement" to any individual, at anytime, without prior written notice.

"The agreement" does not grant a license or any other right to or in my copyright or trademark. I reserve the right in my sole discretion to terminate or modify your permission to use my graphics/artwork/printables/designs at any time pursuant to "the agreement". I reserve the right to take action against any use that does not conform to "the agreement," infringes any of my intellectual property or other right, or violates other applicable law. I reserve the sole right to determine the forum/venue of any legal proceedings necessary to protect my legal rights to my copyrighted graphics/artwork/printables/designs.

I reserve the right to modify or change the terms of this agreement at any time without prior written notice. A current copy of my "Limited Use Agreement" will be posted on my web site at www.grandmageorge.com.

Disclaimer: My graphics/artwork/printables/designs have been brought to you in good faith. I have no control over the physical conditions surrounding the application of my graphics/artwork/printables/designs as presented. I disclaim liability for any untoward results.

Your purchase of my "Limited Use Agreement" and the purchase and/or use of my graphics/artwork/printables/designs on items/products you sell is your legal binding agreement to the above mentioned terms.
